1. Agreement to Terms

By accessing or using the Aiko Assistant service ("Service") operated by Aiko Assistant ("Aiko," "we," "us," or "our"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, you may not use the Service.

2. Description of Service

Aiko provides a personal AI executive assistant accessible via a dedicated web interface at a subdomain of aikoassistant.com. Each customer receives their own isolated assistant instance that can help with tasks including email management, scheduling, research, document preparation, and general task execution.

3. Account Registration

To use the Service, you must:

  • Be at least 18 years of age.
  • Provide accurate and complete registration information.
  • Maintain the security of your account credentials.
  • Notify us immediately of any unauthorized use of your account.

You are responsible for all activity that occurs under your account. We are not liable for any loss or damage arising from your failure to secure your account.

4. Pricing and Payment

  • Setup fee: A one-time, non-refundable fee of $199 is charged at the time of purchase to provision your AI assistant.
  • Monthly subscription: A recurring fee of $49 per month is charged to maintain your assistant. Your subscription renews automatically each month.
  • Annual subscription: An annual billing option is available at $480 per year ($40 per month equivalent). Annual subscriptions renew automatically each year.
  • Payment processing: All payments are processed by Stripe. By providing payment information, you authorize us to charge your payment method for all fees incurred.
  • Price changes: We may change our pricing with 30 days' advance notice. Continued use of the Service after a price change constitutes acceptance of the new pricing.

5. Cancellation and Refunds

You may cancel your subscription at any time from your dashboard or through the Stripe billing portal.

  • Upon cancellation, your assistant will remain active until the end of your current billing period.
  • After the billing period ends, your assistant will be deprovisioned and its data will be deleted.
  • The $199 one-time setup fee is non-refundable.
  • Monthly subscription fees are non-refundable for partial months.
  • Annual subscription fees are non-refundable for partial years.

6. Your Data

You retain ownership of all data you provide to or generate through your AI assistant. Specifically:

  • Your data is yours: We claim no ownership over the content of your conversations, files, or any output generated by your assistant.
  • Isolation: Your assistant operates in an isolated environment. Your data is not accessible to other customers or commingled with other customers' data.
  • No data selling: We do not sell, license, or otherwise make your data available to third parties.
  • No AI training: Your data is not used to train, fine-tune, or improve AI models.
  • Privacy: We do not routinely access or review the content of your assistant interactions. Our staff may access your data when necessary to provide technical support you have requested, troubleshoot issues affecting your service, or comply with legal obligations.
  • Encryption: Your data is encrypted at rest and in transit.

7. Acceptable Use

You agree not to use the Service to:

  • Violate any applicable laws or regulations.
  • Infringe on the intellectual property or other rights of any third party.
  • Transmit malware, viruses, or other harmful code.
  • Attempt to gain unauthorized access to our systems or other customers' data.
  • Engage in harassment, abuse, or threats against any person.
  • Generate content that is illegal, harmful, or violates the rights of others.
  • Resell or redistribute the Service without our written consent.

We reserve the right to suspend or terminate your account if we reasonably believe you are violating these terms.

8. Service Availability

We strive to maintain high availability of the Service but do not guarantee uninterrupted access. The Service may be temporarily unavailable due to maintenance, updates, or circumstances beyond our control. We will make reasonable efforts to notify you of planned downtime in advance.

9. AI Assistant Limitations

Your AI assistant is a tool that operates based on artificial intelligence. You acknowledge that:

  • The assistant may produce inaccurate, incomplete, or inappropriate responses.
  • The assistant's output should not be relied upon as professional, legal, financial, or medical advice.
  • You are responsible for reviewing and verifying any actions taken or content produced by your assistant.
  • The assistant's capabilities may change over time as the underlying technology is updated.

10. Limitation of Liability

To the maximum extent permitted by law, Aiko and its officers, directors, employees, and agents shall not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits or revenues, whether incurred directly or indirectly, or any loss of data, use, goodwill, or other intangible losses resulting from your use of the Service. Our total liability for any claim arising from these Terms or the Service shall not exceed the amount you paid us in the 12 months preceding the claim.

11. Disclaimer of Warranties

The Service is provided "as is" and "as available" without warranties of any kind, whether express or implied, including but not limited to implied warranties of merchantability, fitness for a particular purpose, and non-infringement. We do not warrant that the Service will be error-free, secure, or uninterrupted.

12. Indemnification

You agree to indemnify and hold harmless Aiko and its officers, directors, employees, and agents from any claims, damages, losses, liabilities, and expenses (including reasonable attorneys' fees) arising from your use of the Service, your violation of these Terms, or your violation of any rights of a third party.

13. Changes to Terms

We may modify these Terms at any time. We will notify you of material changes by email or by posting a notice on our website at least 30 days before the changes take effect. Your continued use of the Service after changes become effective constitutes acceptance of the revised Terms. If you do not agree to the revised Terms, you may cancel your subscription.

14. Governing Law

These Terms shall be governed by and construed in accordance with the laws of the State of Delaware, without regard to its conflict of law provisions.

15. Termination

We may terminate or suspend your account and access to the Service at our sole discretion, without prior notice, for conduct that we believe violates these Terms or is harmful to other users, us, or third parties, or for any other reason. Upon termination, your right to use the Service will cease immediately.

16. SMS Messaging

Aiko Assistant ("Aiko Assistant SMS") offers optional SMS messaging so you can communicate with your AI assistant via text message. By opting in to SMS, you agree to the following:

  • Program description: Aiko Assistant SMS enables two-way text messaging between you and your personal AI assistant. Your assistant can respond to questions, deliver schedule summaries, reminders, task updates, and other information you request.
  • Opt-in: You must explicitly opt in to SMS by entering your phone number in your assistant's configuration dashboard, verifying it via a one-time code, and confirming consent. You will not receive messages unless you complete this process.
  • Message frequency: Message frequency varies based on your usage. Your assistant sends messages in direct response to your requests and conversations. You control how often you interact with your assistant.
  • Message and data rates: Standard message and data rates from your wireless carrier may apply. Aiko does not charge any additional fees for SMS messaging beyond your subscription.
  • Opt-out: You can stop receiving SMS messages at any time by replying STOP to any message from your assistant, or by removing your phone number from your assistant's configuration in the dashboard. After opting out, you will receive a single confirmation message and no further SMS messages will be sent.
  • Help: Reply HELP to any message from your assistant for support information, or contact us at [email protected].
  • Privacy: Your phone number and message data are handled in accordance with our Privacy Policy. We do not sell or share your phone number or message data with third parties for marketing purposes. For full details on our SMS messaging practices, see our SMS Messaging Policy.
